Terms and Conditions

Welcome to Tavo (the “App”), operated by Eaty Paradise Inc. (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the App, our website, and related services (collectively, the “Services”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

• You must be at least 13 years old to create an account.

• If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the App.

• Coaches, parents, or guardians are responsible for obtaining necessary consents from minors and for supervising their use of the App.

2. Account Registration

• You may be required to register and create an account to access certain features.

• You must provide accurate and complete information.

• You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal or authorized team use, subject to these Terms.

4. User Content (Including Videos)

• You retain ownership of all content you upload, including videos, images, and text (“User Content”).

• By uploading User Content, you grant Eaty Paradise Inc. a worldwide, royalty-free, sublicensable license to store, host, process, analyze, reproduce, modify, and create derivative works of the content for the purposes of operating and improving the Services, training and improving our machine learning models, and developing new features.

• You represent that you have all rights, permissions, and consents necessary to upload and share the User Content, including for individuals who appear in videos (especially minors).

• You agree not to upload content that violates any law or infringes the rights of any third party.

5. Children and Minors in Videos

Because our App analyzes sports footage, videos may include children under 18. By uploading any such content, you confirm that:

• You are a parent, legal guardian, or have obtained all necessary consents to record and upload footage of minors.

• You understand and consent to Eaty Paradise Inc.’s processing, analysis, and storage of these videos, including for machine learning purposes, as described in these Terms and our Privacy Policy.

6. Data Storage and Processing

• We store User Content and personal data on servers hosted by Microsoft Azure.

• Data may be stored or processed in the United States, Canada, or other locations depending on server availability.

• By using the Services, you consent to this cross-border storage and processing.

7. Privacy

Please review our Privacy Policy for information on how we collect, use, and protect your data. By using the App, you consent to our privacy practices, including our use of uploaded videos for machine learning and analytics.

8. Prohibited Conduct

You agree not to:

• Upload content you do not have the right to upload.

• Violate any applicable law or regulation.

• Use the App to harass, exploit, or harm others, including minors.

• Attempt to reverse-engineer, decompile, or otherwise tamper with the App or its security features.

9. Subscriptions and Payments

• After your free trial, you may be required to pay fees to access certain features.

• Subscription terms, including renewal and cancellation, will be presented within the App Store or App interface.

• All fees are non-refundable except as required by applicable law.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may also delete your account at any time.

11. Intellectual Property

All rights, title, and interest in the App and Services (excluding User Content) are owned by Eaty Paradise Inc. and its licensors.

12. Disclaimer of Warranties

The Services are provided “as is” without warranties of any kind. We do not guarantee that the App will be error-free or uninterrupted.

13. Limitation of Liability

To the maximum extent permitted by law, Eaty Paradise Inc. will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.

14. Indemnification

You agree to indemnify and hold harmless Eaty Paradise Inc. from any claims, liabilities, or expenses arising from your use of the Services or your violation of these Terms.

15. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last Updated” date. Continued use of the Services after changes constitutes acceptance of the new Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.
